Terms of Service — Pets Essentials UK

These terms apply when you use petessentialsuk.com or buy goods from Pets Essentials through our website.

In these terms, “we”, “us” and “our” mean Pets Essentials. “You” means the person using our website or placing an order.

Please read these terms before placing an order. They do not limit any rights you have under consumer law. If any part of these terms conflicts with a right that the law gives you, that legal right takes priority.

 

When you place an order through our website, you are making an offer to buy the goods in your basket on these terms. Our automated email acknowledging receipt of your order does not mean that we have accepted it.

A contract is formed when we email you confirming that we have accepted your order. Please check your order details and contact us promptly if anything is wrong.

We may decline or cancel an order before accepting it, for example if goods are unavailable, there is an obvious pricing or description error, or we cannot verify or process your payment. If we have taken payment for an order we do not accept or later cancel, we will refund the amount paid for the affected goods and any applicable delivery charge.

 

Prices are shown in pounds sterling (GBP). The total price payable, including any applicable taxes and delivery charges, will be shown before you place your order. Where VAT applies, it is included in the displayed price.

Payment is taken using the payment method you select at checkout. Payments are processed through Shopify and/or its payment providers. Your payment details are handled by those providers; we do not intend to store your full card details.

 

We take care to describe and display our products as accurately as possible. Images are for illustration: colours may look different on different screens, and packaging or product details may change where the change does not materially alter the product. These variations do not affect your statutory rights if goods are not as described.

Products are subject to availability. If something you ordered becomes unavailable, we will contact you and, if we cannot fulfil it, refund any payment taken for that item.

 

We deliver to the UK. Available delivery options, charges and estimated delivery times will be shown at checkout or otherwise provided before you place your order. Please check the delivery details entered at checkout are correct.

We will deliver your order within the time agreed with you. If no delivery time has been agreed, we will deliver without undue delay and, in any event, within 30 days of the contract being made. If delivery is delayed, please contact us. Where the law allows you to set an additional reasonable delivery period or cancel because of a delay, your rights are unaffected by these terms.

We may send an order in more than one delivery. You will not pay extra delivery charges for a split delivery unless you agreed to them at checkout.

The goods remain at our risk until they come into your physical possession, or the possession of someone you nominate to receive them (other than a carrier you arrange yourself).

 

You may have a 14-day statutory right to cancel an online purchase, as well as additional return rights under our policy. Exclusions and the conditions that apply are explained in our Return & Refund Policy.

Please read that policy for how to cancel, return postage costs, refund arrangements and the additional 30-day goodwill return offer. Nothing in these terms reduces your statutory cancellation rights.

 

Goods must meet the standards required by law, including being of satisfactory quality, fit for purpose and as described. If goods are faulty or otherwise do not conform to the contract, you may have rights to reject them, request a repair or replacement, or receive a price reduction or refund, depending on the circumstances and timing.

Our products are intended for domestic or household use with pets, as described on the product page and in any instructions supplied. Please read and follow the manufacturer’s instructions, warnings and age or suitability guidance, and use products only for their intended purpose. Supervise pets where appropriate and stop use if a product appears damaged or unsuitable.

Any food, plant-growing product or other consumable should be stored, prepared and used according to its packaging and instructions. Our product information is not veterinary advice. If you are concerned about your pet’s health or a product’s suitability, consult a vet.

Nothing in this section excludes or limits any responsibility we have under consumer law.

 

Please use our website lawfully and responsibly. You must not misuse it, interfere with its operation, attempt unauthorised access, introduce harmful code, or use automated tools to scrape or copy website content without our permission.

If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. Please tell us promptly if you believe your account has been accessed without permission. We may suspend or close access where reasonably necessary to protect our website, customers or business, or to address misuse.

 

If you submit a review, photograph or other content to us, you confirm that you have the right to share it and that it is lawful and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and share that content in connection with our store, products and marketing. We will not claim ownership of your content. Please contact us if you believe content has been used improperly or wish to discuss its removal.

 

Our Privacy Policy explains how we collect and use personal information, including information needed to process orders, manage accounts and, where permitted, send marketing.

 

Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory rights as a consumer.

Subject to the paragraph above, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was made. Where the law permits, our total liability in connection with an order will not exceed the amount you paid for that order. This limit does not apply where it would unlawfully restrict your rights or our liability.

 

We are not responsible for delay or failure caused by events beyond our reasonable control, such as severe weather, transport disruption, strikes, or interruption to essential services. We will take reasonable steps to reduce the effects and keep you informed where appropriate.

This section does not remove your legal rights. If an event means we cannot fulfil your order, we will contact you and refund any amount due for goods we cannot supply.

 

We may update these terms from time to time. The version in force when you place your order applies to that order, unless a change is required by law or we agree a change with you. Please check this page for the latest version before placing a new order.

 

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you will also retain any mandatory consumer protections and rights to bring proceedings available to you under the law that applies where you live.
